To trust or not to trust the MACC

The Malaysian Anti-Corruption Commission (MACC) is internationally recognised for its reputation in fighting graft in Malaysia. Its bosses too are highly-ranked for their credibility in leading the much-afraid commission.

I have developed a good contact and rapport with some of its senior officials, especially after my blog post in February 2011 exposed a scandal at the MCMC.

Apart from that, the relation goes too mutual.

However, 17 months after giving my statements and proof to the MCMC and MACC, the case seems to lead to nowhere although a superintendent with the MACC confirmed that the commission had tangible evidence to file a case against the 'special officer' to the minister.

Even few officers at the MCMC confirmed that the special officer - who months later was conferred a datukship (for making quick bucks out of the laptop contract?) - got a good hand from the top people at a ministry and the commission.

I was delighted with the outcome of the initial investigation.

The MACC superintendent did his job quite well in collecting evidence and related documents which would implicate the guy in court.

Then, towards the year end, there was a lull.

When I called up the superintendent a few times, he said he was in Sabah, all the time in Sabah. And each time I asked about the case, he refused to feed me with details. Instead, he gave me the name of another officer whom I should liaise with in Putrajaya.

But that officer too refused comments. The only thing he said was 'dont worry, we have enough proof and we will prosecute him soon'.

After that, nothing happened. In fact, the officer refused to see me while the superintendent said he was still in Sabah. Was he transferred to Sabah for his investigative role in the case? He has also deleted my name and phone number from his list because when I SMSed him last nite, he replied 'I am in Sabah, and who is this?'

Nope! I don't blame him but I am taking the MACC to task for neglecting the case. I believe some big guns have applied pressure on the MACC to put the case to 'rest'.

Or was there a cover-up?

So, how am I suppose to trust the integrity of the MACC if the top people cannot touch politicians and the 'big fish'? O-oh, maybe they are too busy nabbing the small fish for the sake of fulfilling their responsibility in fighting corruption!

Until the MACC explains what actually happened to the case, I will continue my pursuit for an answer...a logic one, of course!

bro bujai,

i also suspect a cover-up because the guy works with rais yatim, the minister who is also in charge of the mcmc.

if the guy is found guilty, it will also reflect on the minister for his bad choice of making him a special officer.

that also u dont know aaar!!!

saya syak ada yang tak kena dengan SPRM ni.

jika benar mereka sudah ada bukti kukuh, kenapa tak dakwa saja mamat tu?

lainlah kalau ada tekanan atau arahan agar kes ini dimatikan begitu saja demi menutup malu orang lain.

saya syorkan tuan buat laporan polis ke atas SPRM ni...

i dont think we can trust the macc much.

i had a similar case about 'proof'.

a year ago, a friend took a photo of a datuk taking 20k from someone for his promise to help influence a minister to award a contract.

the datuk said if he fail, he will return the money after 3 months. after 8 months, nothing happend, so my friend lodge a report to the macc.

u know what the macc officer did? he wanted to arrest my friend for giving that money!

MACC maknanya 'main atas cilok-cilok'.

dalam erti kata lain, mereka tak berani sangat siasat kes berprofil tinggi dan orang atas2 ni.

sebab tu la diorang akan puas hati kalau dapat cekup konstabel polis yang ambil rm5 daripada penunggang motosikal yang takda cukai jalan!

i think its time for the macc to look into all reports whether it involve big or small fish.

there musnt be any bias ruling in carrying out their duty, especially when the politicians are involved.

if your case is strong enough, what's keeping the macc from prosecuting the special officer?

pelik tetapi ada asasnya.

kalau ada orang politik atau mereka yang bekerja dengan orang politik terbabit, maka adalah pihak tertentu yang akan cuba memujuk orang sprm agar menutup atau menggugurkan tuduhan.

ia bukan saja berlaku di malaysia malah di kebanyakan negara di dunia.

apabila kuasa politik itu melebihi bidang kuasa sesuatu institusi, maka inilah hasilnya!

kesian kat kau.

aku pun tau pasal kes tu dan bukti yang ada.

semua bukti menunjukkan ada pembabitan pegawai berkenaan dalam mendapatkan kontrak skmm untuk sykt2 terbabit.

sprm mungkin tidak berniat meneruskan siasatan kerana wujudnya keadaan di mana ia tersepit di antara politik dan tanggungjawab.

dalam sebahagian kes, politik mengatasi segala-galanya.

maaflah cakap...

Unless we make MACC answerable to Parliment and them MACC boss appointed by Parliment,you can forget about MACC being inderpendent body.Dont waste your time.

is the macc an independent body, is still a question.

in many countries, anti-corruption agencies are not politically-attached and is free from any govt's hook.

however in malaysia, the govt have total control on the body, thus making it difficult to carry out its duty without any interference.

the case is closed. if no action was taken after they collected strong evidence, means nothing will happen. u did a good job but they cant move because of politics...

boleh percaya sikit je pada sprm ni sebab selain buat siasatan sendiri, mereka juga perlu menilai kesan tangkapan dan pendakwaan di sudut politik, takut akan jejas nama baik seseorang pemimpin dan memburukkan nama baik kerajaan. ia memang tidak adil kerana ada yang terlepas. macam sdr kata, mereka hanya lebih berminat menahan pesalah kecil sedangkan yang kepala rasuah tidak berani didekati. inilah satu sistem tidak adil di negara ini tetapi tidak banyak dapat dilakukan sehinggalah ia diperbetulkan dan sprm perlu menjadi sebuah badan yang benar2 bebas. sayang kerana usaha yang sdr buat dan ramai lagi tidak dihargai kerana sprm sendiri pun terikat dengan usaha menjaga nama baik kerajaan. pada waktu yang sama, ada juga pegawainya yang korup dan mudah disogok agar tidak mengambil tindakan ke atas orang yang bersalah.

better forget the case because the MACC will not pursue it for some reasons.

i have been waiting for this case too but i eventually agreed that some cases were closed for good cover ups.

dengar khabar, jabatan imigresen sekarang ni paling banyak rasuah tetapi takda siapa berani buat aduan kepada sprm.

rasuah mengenai pengurusan pekerja asing berlaku di mana2 saja...

go on bro, its a noble thing to do. whether the macc investigates your case or not, you must go on because this is a high profile case, something which the macc is SCARED to take action!

the macc is not independent. thats why many big cases are ignored.

those at the top are government-appointed. their hands are tied up, they are only free to work on small cases. maybe once in a while they will go after big cases but still, politics have a big hand.

so, there is no just in the system!

sebab itulah dalam kerajaan, kita tak boleh dilihat buat kerja bagus. buat je kerja bagus, kena transfer,lebih2 lagi kalau kes tu libatkan orang politik.

apa nak buat sebab sistem yang ada sukar diubah.

kalau kerajaan tak bagi perhatian kepada perkara semacam ini, rasuah takkan dapat dikawal kerana masih ramai kepala besar yang tidak dapat diusik oleh undang2!

gaji orang sprm ni kerajaan yang bayar. mereka pun nak jaga periuk nasi sendiri. kalau cekup ikan jerung dalam kerajaan, alamat kena tukar kerja, pindah atau masuk peti sejuk la gamaknya...

aku rasa supp tu pun dah jadi mangsa keadaan.

susah nak kawal rasuah, apa lagi nak hapuskannya jika orang yang bertanggungjawab memeranginya pun turut terbabit.

dalam banyak kes, politik akan mengatasi segala peraturan yang ada demi melindungi nama baik seseorang pemimpin dan kerajaan.

jadi, kita tidak ada pilihan kecuali menerima sistem ini seadanya.
